Hello, my name is John Kelly and I’m a personal injury attorney in Phoenix, Arizona. I want to talk to you today about Side Impact Auto Accidents. If you’ve been in an accident where you’ve been hit from the side, T-boned as it’s often called, there are some unique things that you should be aware of. These accidents often include drivers that were very negligent. They either ran a red light, they made a turn that they shouldn’t have, and your damages are often very high because vehicles aren’t often equipped to handle side impacts as well as they are, typically, with front impacts.
Establishing liability, what happened in the accident, can be important. You want to go through the police reports. First, you want to call the police if you haven’t already; but if they have taken a report, you want to go through them, you want to talk to your attorney about what happened in the reports, what follow-up witnesses you might have, what things you can consider. You may even want to get an accident reconstruction based on the damages that you have. These can be helpful in showing the insurance company the negligence that occurred from the other party.
Once you’ve established that liability, you can go on to focus on what your damages are. And as I said, side impact cases often jerk people in ways that they, their bodies were never meant to be moved, so their injuries can be very bad. A side whiplash is different than a front whiplash and it can often really mess with their back, and make the recovery process long. You want to get the diagnosis from the doctors, so you want to go to your doctors’ visits, you want to get your physical therapy, and you want to make sure that you’re doing what you can to get the documentation of what your injuries are. The other thing you want to do is take notes about what you’ve been through and look at what lost wages you might have. What other damages do you have in this claim that you can present to the insurance company or adjusters to make sure that you’re maximizing your recovery?
At my law firm, we focus on making sure that you have all the resources you need to make a successful claim. If you’d like to go over how to maximize your recovery in a side impact case, please give us a call, 602-283-4122.
