There are many times I will receive a call from a car accident victim wants to know if they have a valid case.

One of the key questions I always ask is “What type of injury you suffered as a result of someone else’s carelessness?”

Some of these accident victims reply “My back!”

That tells me immediately that this is not the right type of case for me. This tells me immediately that this injured victim was not diagnosed with any definable injury.

At least not yet.

When an injured car accident victim says that they hurt their back, it means that no doctor has diagnosed them with a fracture. It means that no doctor has diagnosed them with a specific disabling medical condition based upon diagnostic imaging tests such as a CAT scan or MRI.

It means that this is most likely a soft tissue case.
That means it would not meet the injury threshold needed in order to bring a valid case here in New York.

When you are involved in a car accident, in order to bring a lawsuit, you must have suffered some type of “serious injury.”

The law is very specific about what actually is a serious injury. There are nine separate definitions for this phrase.

To give you an example, if you received a fracture or broken bone, that would be considered a serious injury. So would scarring.
